Agreement to Terms

By accessing or using Pacific North North (“Platform,” “we,” “our”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our platform. These terms apply to all users, including customers and vendors.

Description of Service

Pacific North North is an Alaska-first marketplace connecting travelers with local adventure operators, guides, and outfitters. We facilitate bookings and payments between customers and vendors but are not a party to the actual adventure services provided.

User Accounts

Registration

• You must be at least 18 years old to create an account
• You must provide accurate and complete information
• You are responsible for maintaining account security
• You may not share your account credentials

Account Termination

We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or for any other reason at our discretion.

For Customers

Bookings

• All bookings are subject to vendor availability and approval
• You agree to pay the full amount at the time of booking
• You must provide accurate contact information
• You are responsible for arriving prepared for your adventure

Cancellations and Refunds

• Cancellation policies are set by individual vendors and displayed on each listing
• Refunds are processed according to the vendor's cancellation policy
• Weather-related cancellations are handled per vendor policy
• Platform fees are non-refundable unless required by law

For Vendors

Vendor Requirements

• You must have all necessary licenses, permits, and insurance
• You must provide accurate listing information
• You must honor confirmed bookings
• You must maintain professional standards of service
• You must comply with all applicable laws and regulations

Listing Content

• You own the content you post but grant us a license to display it
• Content must be accurate and not misleading
• You may not use copyrighted images without permission
• We reserve the right to remove listings that violate our policies

Payments

• You must connect a valid Stripe Connect account
• Payouts are processed according to your payout schedule
• Platform fees are deducted from each transaction
• You are responsible for all applicable taxes

Platform Fees

Pacific North North charges a service fee on each transaction:

• Customers pay the listed price plus any applicable taxes
• Vendors receive the listed price minus platform fees and payment processing fees
• Fee structure is disclosed during vendor onboarding
• Fees are subject to change with 30 days notice

Prohibited Conduct

You may not:

• Violate any laws or regulations
• Impersonate others or provide false information
• Harass, threaten, or abuse other users
• Attempt to circumvent platform fees
• Use the platform for fraudulent purposes
• Scrape or copy content without permission
• Interfere with platform security or functionality
• Post offensive, discriminatory, or inappropriate content

Intellectual Property

The Pacific North North platform, including its design, features, and content (excluding user-generated content), is owned by us and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute our content without permission.

Disclaimer of Warranties

THE PLATFORM IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THE QUALITY, SAFETY, OR LEGALITY OF VENDOR SERVICES. WE ARE NOT RESPONSIBLE FOR VENDOR CONDUCT, ADVENTURE QUALITY, OR CUSTOMER SATISFACTION. USE OF THE PLATFORM IS AT YOUR OWN RISK.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PACIFIC NORTH NORTH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE PLATFORM. OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE PAST 12 MONTHS.

Indemnification

You agree to indemnify and hold Pacific North North harmless from any claims, damages, or expenses arising from your use of the platform, your violation of these terms, or your violation of any rights of others.

Dispute Resolution

Any disputes arising from these terms or use of the platform shall be resolved through:

1. Informal negotiation
2. Mediation (if negotiation fails)
3. Binding arbitration under the rules of the American Arbitration Association

You waive your right to participate in class action lawsuits.

Governing Law

These terms are governed by the laws of the State of Alaska without regard to conflict of law principles. Any legal action must be brought in the courts located in Alaska.

Changes to Terms

We may modify these terms at any time. We will notify you of material changes via email or platform notification. Continued use of the platform after changes constitutes acceptance of the updated terms.

Severability

If any provision of these terms is found to be unenforceable, the remaining provisions shall remain in full effect.
